Terms of Service

Welcome to Rock Identifier ("App"), a product developed by Gigantic Apps. These Terms of Service ("Terms") govern your access to and use of the App, which is available through the Google Play Store and Apple App Store.

By using Rock Identifier, you agree to these Terms. If you do not agree, please do not use the App.

1. Use of the App

Rock Identifier allows users to:

• Capture photos of rocks and stones using the in-app camera
• Upload existing photos from their device gallery for identification
• Receive AI-powered identification of rocks, stones, and minerals
• View detailed information about identified rocks, including properties, composition, and characteristics
• Use the AI chat feature to ask questions about rocks, minerals, geology, and related topics
• Save identification results and chat history locally on their device
• Subscribe to unlock Pro features and remove identification limits

You must be at least 13 years old to use the App.

2. Accuracy of Information

Rock Identifier uses artificial intelligence to identify rocks and provide geological information. While we strive for accuracy:

• Identifications are provided for informational and educational purposes only
• Results may not always be 100% accurate and should not be used as the sole basis for professional, commercial, or safety-critical decisions
• For professional geological assessments, consult a qualified geologist or expert
• We do not guarantee the accuracy, completeness, or reliability of any identification or information provided

3. Subscriptions & Payments

We may offer subscriptions via RevenueCat to unlock premium features:

• Payment is charged to your Google or Apple account at confirmation of purchase
• Subscriptions auto-renew unless canceled at least 24 hours before the current period ends
• Manage or cancel subscriptions in your app store account settings
• Pricing may vary by region and is displayed before purchase

4. Content Usage & Ownership

You retain all rights to your original images. By uploading images to the App, you grant us a temporary, non-exclusive license to process them solely for the purpose of providing rock identification services.

Images and chat messages are processed in real-time and deleted shortly after processing is complete. We do not claim ownership of your content.

You agree not to upload illegal, offensive, or infringing content, or use the chat feature to request inappropriate information.

5. Prohibited Conduct

You agree not to:

• Use the App for illegal activities or to generate harmful content
• Upload images or send chat messages containing hate speech, harassment, explicit content, or other harmful material
• Attempt to abuse, exploit, or overwhelm the App's services or servers
• Reverse-engineer, decompile, or attempt to extract source code from the App
• Use the App to infringe on intellectual property rights of others
• Impersonate others or misrepresent your identity or affiliation
• Collect or harvest user data from the App
• Use automated systems (bots, scrapers) to access the App without permission

6. Intellectual Property

All App branding, design, functionality, algorithms, and related intellectual property belong to Gigantic Apps or its licensors. You may not copy, modify, distribute, sell, or create derivative works without our express written permission.

7. Privacy

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use, and protect your data.

8. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your app store account
• All activities that occur through your account
• Ensuring your use of the App complies with applicable laws and regulations
• Obtaining necessary permissions before photographing rocks on private or protected property

9. Disclaimers & Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or reliability of rock identifications
• Uninterrupted or error-free operation
• Fitness for a particular purpose

To the fullest extent permitted by law, Gigantic Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any inaccurate identifications or information provided by the App
• Unauthorized access to or alteration of your data
• Any other matter relating to the App

10. Indemnification

You agree to indemnify and hold harmless Gigantic Apps, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

You may stop using the App at any time. Upon termination, these Terms will continue to apply to any prior use of the App.

12. Changes to Terms

We may revise these Terms at any time by updating this page. The updated Terms will be effective upon posting, and the "Effective Date" will be updated accordingly. Your continued use of the App after changes constitutes acceptance of the revised Terms.
